These Terms of Service ("Terms") govern your access to and use of Homerr, a platform operated in Kenya that connects tenants, landlords, and independent service providers ("HomerrFix"). By creating an account or using Homerr, you agree to these Terms.
Homerr ("we", "our", "us") operates a marketplace for rental property listings and on-demand home services (HomerrFix) in Kenya. We are an intermediary platform — we do not own, manage, or provide the properties or services listed, and we are not a party to any tenancy agreement or service contract formed between users.
You must be at least 18 years old and capable of entering a binding contract under Kenyan law to use Homerr. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information during registration and keep it up to date.
Tenants may browse and apply for listings, book service requests through HomerrFix, and communicate with landlords and providers via the platform. Landlords are solely responsible for the accuracy of their listings, the legality of their properties, and compliance with Kenyan tenancy law. Service providers are independent contractors, not employees or agents of Homerr, and are solely responsible for the quality, safety, and legality of the services they perform.
All property listings are subject to admin review and approval before appearing publicly. Landlords must not post misleading, fraudulent, or duplicate listings. Homerr reserves the right to reject, suspend, or remove any listing that violates these Terms or applicable law, including listings flagged or reported by other users.
Homerr may charge service fees for bookings, HomerrFix job completions, or premium features, as disclosed at the point of transaction. Payments processed through the platform, including any wallet balance, are subject to our separate wallet disclosure. Homerr is not a bank or licensed payment service provider under the Central Bank of Kenya; see our wallet terms for details on how funds are held and moved.
Tenancy applications, tours, and HomerrFix jobs may be cancelled subject to the cancellation terms shown at the time of booking. Disputes between users (e.g. tenant vs. landlord, tenant vs. provider) should first be raised through the in-platform chat or reported via the report/flag feature. Homerr may, at its discretion, mediate disputes but is not obligated to do so and is not liable for the outcome of any dispute between users.
You may not use Homerr to: post false or discriminatory listings; harass, defraud, or impersonate other users; circumvent the platform to avoid fees; upload malicious code; or violate any applicable Kenyan law, including the Data Protection Act 2019, the Rent Restriction Act, and consumer protection legislation.
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users, with or without prior notice. You may delete your account at any time via your account settings; see our account deletion policy for details on what happens to your data.
To the maximum extent permitted by Kenyan law, Homerr is provided "as is" without warranties of any kind. We are not liable for any loss, damage, injury, or dispute arising from interactions between users, the condition of any property, or the quality of any HomerrFix service, except where such liability cannot be excluded by law.
We may update these Terms from time to time. Material changes will be communicated via the platform or by email. Continued use of Homerr after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Kenya. Any disputes not resolved through platform mediation shall be subject to the exclusive jurisdiction of the courts of Kenya.
